01Who we are
Pixel Creative (“Pixel Creative”, “we”, “us”) is a growth marketing agency based in Miami, Florida and New York, New York. This Privacy Policy explains how we collect, use, share and protect personal information when you visit pixelcreativeagency.com (the “Site”), contact us, book a call, receive messages from us, or use Skala AI, our growth platform (together, the “Services”).

02Information we collect
Information you give us. Your name, email address, phone number, company, website, budget range, the content of your messages, booking details and anything you share during calls. If you become a client, we also collect billing contacts and the information needed to run your campaigns, pages, automations and accounts.
Information collected automatically. When you use the Site, we and our providers collect device and browser details, IP address, approximate location, pages viewed, referring pages and how you interact with the Site, using cookies, pixels and similar technologies.
Information from third parties. We may receive information from advertising and analytics platforms (such as Meta, Google, TikTok and LinkedIn), scheduling and CRM tools, and publicly available business sources.
03How we use information
- To respond to inquiries and schedule calls.
- To provide, operate, maintain and improve the Services, including Skala AI.
- To send service, transactional and appointment messages, and marketing messages where permitted.
- To measure and improve the Site, our content and our advertising.
- To keep the Services secure and prevent fraud or misuse.
- To comply with legal obligations and enforce our agreements.
04Text messages (SMS)
If you give us your phone number and consent, we may send you text messages about your inquiry, appointments and our services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for help. Consent to receive text messages is not a condition of any purchase.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are excluded from every information-sharing category in this policy and will not be shared with any third parties.
05Cookies and tracking
We use cookies, pixels and similar tools, including Google Analytics, Google Ads, the Meta Pixel and the tracking features of our CRM, to understand how the Site is used and to measure our advertising. You can block or delete cookies in your browser settings, and you can manage ad personalization through Google’s Ad Settings and Meta’s Ad Preferences.
Where required by law, we treat a Global Privacy Control (GPC) signal from your browser as a request to opt out of the sale or sharing of your personal information.
06How we share information
We do not sell personal information for money. We share it only as needed with:
- Service providers that host the Site and run our operations, including CRM and marketing automation (such as HighLevel), payments (such as Stripe), scheduling, email and messaging, and analytics.
- Advertising platforms, through pixels and similar tools when you visit the Site or interact with our ads. Under some U.S. state laws this may be considered “sharing” for cross-context behavioral advertising, which you can opt out of.
- AI providers that power certain Skala AI features (see “AI features” below).
- Professional advisers, such as lawyers and accountants, under confidentiality duties.
- Authorities, when required by law or to protect rights, safety and security.
- A buyer or successor, if we are involved in a merger, acquisition or sale of assets.
07Data we process for our clients
When we run campaigns, CRM, messaging or Skala AI for a client, we process personal information about that client’s customers and leads on the client’s behalf and under the client’s instructions. In that role, the client is responsible for its own privacy notice and for obtaining any consents required, including for calls and text messages.
If you are a customer of one of our clients and want to exercise your privacy rights, please contact that business directly. We will help them respond as required.
08AI features
Some Skala AI features use third-party AI models to draft replies, qualify leads, answer calls or summarize conversations. We send these providers only the information needed for the feature to work, under agreements that protect it. Our clients can review, approve or turn off automated responses.
09How long we keep information
We keep personal information only as long as needed for the purposes described in this policy, including to meet legal, accounting and reporting requirements. When it is no longer needed, we delete or anonymize it.
10Security
We use reasonable administrative, technical and physical safeguards to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
11Your rights and choices
Depending on where you live, you may have the right to access, correct, delete or receive a copy of your personal information; to opt out of targeted advertising, sale or sharing; to limit the use of sensitive information; and to appeal our decision on your request.
California and other U.S. states. Residents of California and of other states with comprehensive privacy laws have the rights described above. In the last 12 months we have collected identifiers, commercial information, internet activity, approximate location, professional information and inferences, for the purposes described in this policy. We do not knowingly sell or share the personal information of consumers under 16. We will not discriminate against you for exercising your rights.
Latin America. If you live in Argentina, Peru, Chile, Uruguay or another country with data protection laws, you have the right to access, rectify, update and delete your personal information and to object to its processing, as provided by your local law. You may also file a complaint with the data protection authority in your country.
How to make a request. Email [email protected] with the subject “Privacy request”. We will verify your identity before acting on it and respond within the time required by law. You may use an authorized agent where the law allows. You can unsubscribe from marketing emails at any time using the link in each email, and reply STOP to any text message.
12International transfers
We are based in the United States, and our providers may process information in the United States and other countries. When we transfer personal information across borders, we take steps to protect it as described in this policy and as required by applicable law.
13Children
The Services are intended for businesses and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
14Links to other sites
The Site may link to websites and services we don’t control. Their privacy practices are governed by their own policies.
15Changes to this policy
We may update this policy from time to time. We will change the “Last updated” date at the top and, if the changes are material, give additional notice as appropriate.
